Risk Management assists providers and staff with responding to licensing board investigations, including those by the Board of Registered Nursing, Dental Board of California, Medical Board of California, Physician Assistant’s Board, and the California State Board of Pharmacy.
Most licensing board investigations are initiated as the result of a patient filing a complaint with the Board about a healthcare provider. As licensing boards are obligated to review all complaints they receive, they will open a file and request records as well as a written response from the provider addressing the allegations the patient made in their complaint. Most of the complaints that licensing boards receive are eventually deemed to be non-meritorious and closed after the board receives the requested records and response from the provider, however there are some that progress to the point of the board wanting to interview the provider and, very rarely, filing an accusation against the provider. Should the matter progress to the point of an interview or accusation, there is limited funds to support retention of an attorney to represent you during interviews and any hearings, not to exceed $20,000 in defense costs.

As there are deadlines to respond to these complaints, please notify Risk Management as soon as you receive any correspondence from a licensing board. Risk Management will assist you in preparing your written response and can answer further questions you may have regarding attorney representation for any licensing board investigation.
